Michelle Young’s Mother Files Wrongful Death Suit

RALEIGH, N.C. -

The family of a murdered Wake County mother is filing a wrongful death lawsuit against her husband.

Michelle Young was beaten to death exactly two years ago this week.

Warrants reveal that investigators have focused on her husband, Jason, but he has never been named a suspect.

Now, Michelle Young's mother wants to prove Jason Young's guilt in civil court.

Lawyers for her mother, Linda Fisher, had a two-year statute of limitations to file a wrongful death suit -- and they got it in just in time.

The papers were filed last week, but kept under seal until Tuesday.

"Linda Fisher will rely heavily on evidence gathered by law enforcement to prove her case, which essentially alleges murder," said attorney Jack Michaels. "They're public servants and they're subject to subpoena to give testimony, and the evidence they've gathered is also subject to subpoena."

The lawsuit comes at a tough time for Fisher, who's waited patiently for whoever killer her daughter to be brought to justice.

"Linda's exhausted, as you can imagine," said attorney Paul Michaels. "Sunday, they had the gravestone service and they unveiled Michelle's gravestone. And then Monday was the second anniversary of Michelle's death."

Wake County investigators say they'll be keeping a close eye on the depositions, affidavits and motions that come out of the civil case.

"We're always looking. We have an active criminal investigation going on and this is just a part that we'll be looking at -- like I said we'll be monitoring it very carefully," said Sheriff Donnie Harrison. "If there's something there that we have an interest in, of course we'll look into it."

Attorneys for Jason Young had no comment Wednesday.

They have 30 days to respond to the suit, but could ask for a 30-day extension.

Fisher's lawyers say the main purpose of the suit is to make sure Michelle's daughter -- and not Jason -- gets the money.

At this point there is not any sort of custody battle.

The couple's daughter still lives with Jason Young, who has moved to Brevard since his wife's death.
