Death Ruled “Justifiable Homicide”

FAYETTEVILLE, N.C. -

An investigation into a burglary that resulted in a suspect being shot has been ruled as a justifiable homicide, Fayetteville police said Thursday.  

Jerry Riley, 54, of Tokay Drive originally reported that he was confronted by an unknown subject upon entering his home on Jan. 17 at 7:15 p.m. Riley pulled a handgun on the intruder who then grabbed him and a struggle ensued. Riley fired multiple shots before the intruder grabbed the gun and ran from the home.

The intruder, who was later identified as Joshua Caleb Pratt, was found lying in the street with a gunshot wound to the abdomen. He was transported to Cape Fear Valley Medical Center where he was pronounced dead.

No charges will be filed in this incident.
