One Cary man who spray painted his home to protest the town says he refuses to paint over the controversial sign until the Town of Cary buys his home.
David Bowden paid to have the words "Screwed By The Town Of Cary" spray painted on the front of his home on Southwest Maynard Road.
"I have got the Town of Cary's attention now," Bowden said. "If I take the sign down, that attention goes with the sign."
The sign violates the Town of Cary's sign ordinance and officials said they do have the option to fine Bowden, but have not done it yet.
Meanwhile, lawyers at the Raleigh branch of the American Civil Liberties Union said the sign ordinance in itself is unconstitutional and Bowden has a right to freely express himself.
Lawyers at the ACLU said they are willing to go to court for Bowden and sent a letter to the Town of Cary explaining their position.

Bowden says he is upset because his home floods when it rains. He claims the problem was caused by the recent Maynard Rd. widening project and he wants the Town of Cary to buy his home.
Town officials said the problem is a maintenance issue, but they have offered to engineer a way to stop the flooding.
"It would be at no cost to him, but he would rather the citizens of Cary buy his home than implement the fix," Assistant town manager Mike Bajorek said.
Bowden has repeatedly rejected the offer and said he wants the town to fix the flooding problem and pay for the water damage in his home or buy the home.
